Terms and Conditions

Dear guest, it goes without saying that we want to make your stay as pleasant as possible. That also means you should know which services we provide, what we stand for and which obligations you have towards us.

Please note our General Terms and Conditions for the accommodation contract, which you accept with your booking.

Scope

1. These terms apply to contracts for the rental of conference, banquet and event rooms of the hotel for events such as banquets, seminars, conferences etc., as well as to all related services and deliveries of the hotel.
2. Terms and conditions of the organiser only apply if this has been expressly agreed in writing.

Conclusion of contract, contracting parties, liability

1. For events, the contract is concluded when the hotel accepts (confirms) the organiser's request; these are the contracting parties.
2. If the customer is not the organiser, or if the organiser engages a commercial agent or organiser, they are jointly and severally liable with the organiser for all obligations arising from the contract.
3. The organiser acquires no right to the provision of specific rooms or premises. If agreed premises are not available, the hotel is obliged to seek equivalent alternatives in the house or in other properties.
4. The hotel is liable for its obligations under the contract. This liability is limited to defects in performance which, apart from those typical of the service, are due to intent or gross negligence on the part of the hotel. The organiser is otherwise obliged to inform the hotel in good time of the possibility of exceptionally high damage arising.

Cancellation conditions

Hotel rooms can be cancelled free of charge up to 24 hours before arrival; late cancellations or no-shows are charged at 100% of the entire stay.

For groups of 5 people or more, free cancellation is possible up to 5 days before arrival; late cancellations or no-shows are charged at 100% of the entire stay.

All HotDeal bookings cannot be cancelled or rebooked free of charge.

Vouchers

Our vouchers are valid for 1 year from the date of issue.

Services and payment

1. The hotel is obliged to provide the services ordered by the organiser and confirmed by the hotel.
2. The organiser is obliged to pay the hotel's agreed prices for these services and also assumes payment of the invoice unless otherwise agreed in writing.
3. Reserved rooms are available to the guest from 3:00 p.m. Unless a later arrival time has been expressly agreed, the hotel reserves the right to allocate booked rooms otherwise after 6:00 p.m. On the day of departure, rooms must be vacated by 11:00 a.m. at the latest, unless a later departure time has been agreed.
4. The agreed prices include the statutory value added tax. Changes to the applicable VAT rate are at the organiser's expense, irrespective of the time the contract was concluded.
5. If the period between conclusion of the contract and provision of the service exceeds 180 days, the hotel reserves the right to change prices without prior notice.
6. Hotel invoices for events without a due date are payable in full within 10 days of receipt of the invoice. In the event of late payment, the hotel is entitled to charge interest of 4 per cent above the respective discount rate of the German Federal Bank.
7. The hotel is entitled to request an appropriate advance payment at any time.
8. Vouchers from tour operators are only accepted if a credit agreement exists with the company concerned or if corresponding advance payments have been made.
9. Claims and rights arising from agreements made with the hotel may only be transferred to third parties with the hotel's consent.

Withdrawal by the hotel

1. If the advance payment is not made even after an appropriate grace period set by the hotel with a warning of refusal, the hotel is entitled to withdraw from the contract.
2. The hotel is further entitled to withdraw from the contract for objectively justified reasons, for example if force majeure or other circumstances beyond the hotel's control make fulfilment of the contract impossible; if events are booked with misleading or false information about essential facts; if the hotel has justified reason to believe that the event may jeopardise smooth business operations; or if the rooms provided are sublet or passed on without prior written consent.
3. The hotel must inform the organiser of the exercise of the right of withdrawal without delay.
4. The organiser has no claim for damages against the hotel, except in the case of intentional or grossly negligent conduct by the hotel.

Withdrawal by the organiser

1. The organiser may withdraw free of charge up to 6 weeks before the start of the event. In the case of later withdrawal, the hotel is entitled to invoice 80 per cent of the originally agreed price if the premises can no longer be rented out otherwise.
2. Saved expenses are thereby settled.

Option dates

Option dates are binding for both contracting parties. The hotel reserves the right to rent out the reserved rooms and premises otherwise after the option date has expired.

Changes to the number of participants and event times

1. A change in the number of participants of more than 5 per cent must be notified to the hotel at least 5 working days before the start of the event and requires the hotel's consent.
2. A reduction in the number of participants of up to 5 per cent is recognised by the hotel when invoicing. For larger deviations, the originally notified number of participants less 5 per cent is used as the basis.
3. In the case of an upward deviation, the actual number of participants is charged.
4. If the number of participants deviates by more than 10 per cent, the hotel is entitled to reset the agreed prices and to exchange the confirmed rooms.
5. If the agreed start or end times of the event change without the hotel's prior written consent, the hotel may charge additional costs for its readiness to perform.

Bringing your own food and drinks

As a rule, the organiser may not bring food and drinks to events. Exceptions require a written agreement with the hotel. In such cases a contribution towards overheads is charged.

Technical equipment and connections

1. Insofar as the hotel procures technical or other equipment from third parties for the organiser at their request, it acts in the name, by authority and for the account of the organiser.
2. The use of the organiser's own electrical equipment via the hotel's power supply requires the hotel's written consent.
3. With the hotel's consent, the organiser is entitled to use their own telephone, fax and data transmission equipment. The hotel may charge a connection fee for this.
4. If suitable hotel equipment remains unused because the organiser connects their own equipment, a compensation fee may be charged.
5. Faults in technical or other equipment provided by the hotel will be remedied immediately where possible.

Loss of or damage to items brought along

1. Exhibition items or other objects brought along are located in the event rooms or in the hotel at the organiser's risk. The hotel accepts no liability for loss, destruction or damage, except in cases of gross negligence or intent on the part of the hotel.
2. Decoration material brought along must comply with fire safety requirements.
3. Exhibition items or other objects brought along must be removed immediately after the end of the event.

Organiser's liability for damage

1. The organiser is liable for all damage to the building or inventory caused by event participants or visitors, employees, other third parties from their sphere or by themselves.
2. The hotel may require the organiser to provide appropriate security (insurance, deposits, guarantees).

Final provisions

1. Amendments or additions to the contract, the acceptance of the request or these terms and conditions for events should be made in writing. Unilateral amendments or additions by the organiser are invalid.
2. The place of performance and payment is the registered office of the hotel.
3. The exclusive place of jurisdiction – including for disputes concerning cheques and bills of exchange – is the registered office of the hotel in commercial transactions.
4. German law applies.
5. Should individual provisions of these general terms and conditions for events be invalid or void, the validity of the remaining provisions shall not be affected. Otherwise, statutory provisions apply.
